Acceptance of Data Policy

1. By accessing and using the datasets provided on Data.gov.bn, you shall be deemed to have
   accepted to be legally bound by these Terms of Use. If you do not agree to these Terms of Use,
   do not use the datasets.
2. These Terms of Use may change from time to time without notice. Please check the Terms of
   Use whenever you access or download the datasets for use.

Conditions of Use

3. Subject to the conditions below, data available on Data.gov.bn is offered free and without other
   restrictions.
4. Any websites, applications, or publications using the datasets must contain the proper
   attribution detailing the source of the datasets and the date the datasets were accessed or
   downloaded
5. All websites, applications or any form of publication should clearly indicate any analysis or
   transformation of data made by the use, and shall not be attributed to the Government of
   Brunei Darussalam.
6. Upon the request of the Government of Brunei Darussalam, all users must cease to use the
   datasets and remove them from your applications, websites, and other publications.
7. Users must not use the data for purposes deemed inappropriate and/or misleading to the
   general public.
8. The breach of any of these Terms of Use shall result in the cancellation of the license to use the
   datasets granted to you under clause 3. These Terms of Use (except for clause 3) shall survive
   the cancellation of the license under clause 4

Disclaimers

9. The datasets are provided on an “as is” basis without warranties from the Brunei Government of
   any kind, including but not limited to any warranty as to the accuracy, correctness, reliability,
   timeliness, non-infringement, title, quality or fitness for any particular purpose of the datasets.
10. The Brunei Government shall not be liable to any users or any third party for damage or loss of
    any kind arising directly or indirectly from your or any third party’s use of, or inability to use, the
    datasets or the relevant Websites.
11. The Government of Brunei Darussalam reserves the right at any time, without notice or liability,
    to remove the datasets from the relevant Websites.

Indemnity

12. You agree to fully indemnify the Government of Brunei Darussalam from any and all claims, demands, losses, liabilities, costs and expenses (including but not limited to legal costs) arising directly or indirectly from:

1. your use of the datasets;
2. your breach of any of these Terms of Use;
3. your violation of any rights of another; or
4. any claim made by a third party in connection with the third party’s use of the datasets
   or any derived analyses or applications which you have provided.

Governing Law

13. This Data Policy and its terms shall be governed by and construed in accordance with the laws of
    Brunei Darussalam. You irrevocably agree that the Bruneian courts shall have exclusive
    jurisdiction in relation to any dispute arising from or relating to this Data Policy and its terms,
    and for such purposes irrevocably submit to the jurisdiction of the Brunei courts.
